Deferred Action for Childhood Arrivals (DREAM Act) Attorneys | Immigration & Citizenship
On June 15, 2012, President Obama passed an executive order establishing a policy called Deferred Action for Childhood Arrivals (DACA). Many people refer to this policy as the DREAM Act, however, this designation is not accurate. The DREAM Act is legislation that requires both houses of Congress to pass. If passed by both houses of Congress, the president would then be presented with the bill for signature. This has not yet happened.
So, what does DACA do and who is eligible?
DACA provides people who entered the US prior to the age of 15 some relief from the threat of deportation for a fixed period of time. This relief is not available for everyone. It is limited to those people who can demonstrate that:

- he or she entered the US before reaching his or her 16th birthday;
- he or she was under the age of 31 as of June 15, 2012;
- He or she has continuously resided in the U.S. since June 15, 2007, through the present time;
- He or she was actually physically present in the U.S. on June 15, 2012, and at the time of filing the application with USCIS;
- He or she either entered the U.S. without inspection before June 15, 2012, or lawful immigration status expired as of June 15, 2012;
- He or she is currently in school, has graduated or obtained a certificate of completion from high school, has obtained a GED, or is an honorably discharged veteran of the U.S. Coast Guard or the U.S. Armed Forces; and
- He or she has not been convicted of a felony, a "significant misdemeanor," three or more other misdemeanors, or does not otherwise pose a threat to the national security of the U.S. or to public safety.
